Terms of Service

1. Acceptance of Terms

By accessing or using Fruition ("the platform," "the service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you are using Fruition on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

Fruition is a farm management software-as-a-service platform designed for specialty growers. The platform provides tools for harvest and batch logging, market session tracking, payroll, inventory management, environmental monitoring, and related farm business functions. The platform is hosted at fruitiongrower.com.

3. Account Registration

Access to Fruition requires an account. You agree to provide accurate information during registration, maintain the security of your credentials, and accept responsibility for all activity that occurs under your account. If you become aware of any unauthorized access, notify us immediately at support@fruitiongrower.com.

4. Acceptable Use

You agree to use Fruition only for lawful farm business purposes. You must not:

• Use the platform for any unlawful purpose or in violation of any applicable regulation.
• Attempt to reverse engineer, decompile, or reproduce any part of the platform.
• Resell or sublicense access to Fruition without written authorization.
• Attempt to access data belonging to other users or farms.
• Interfere with or disrupt the platform's infrastructure, servers, or networks.
• Use automated tools or scrapers to extract data from the platform.

We reserve the right to investigate and take appropriate action against violations of this section, including immediate account suspension.

5. Subscription and Billing

Access to Fruition is offered on a month-to-month subscription basis. There are no long-term contracts or commitments.

• Subscription fees are billed monthly in advance.
• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — there are no refunds or credits for the remaining days in that period.
• You authorize us to charge your payment method on the billing date each month.
• Failure to pay may result in suspension or termination of your account.

We reserve the right to change subscription pricing with at least 30 days' written notice. Continued use of the platform after a price change takes effect constitutes acceptance of the new pricing.

6. Data and Privacy

Your use of Fruition is also governed by our Privacy Policy, which is incorporated into these terms by reference. You retain ownership of all farm data you enter into Fruition. We do not claim ownership of your data and do not sell it to third parties.

7. Third-Party Integrations

Fruition connects to third-party services (including Stripe, QuickBooks, Square, and Expo) at your direction. Each service is governed by its own terms and privacy policy. We are not responsible for outages, errors, or changes caused by third-party services.

8. Disclaimer of Warranties

Fruition is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. Your use of the platform is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Fruition Farm Management shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or business interruption. Our total cumulative liability for any claims arising from your use of Fruition shall not exceed the fees you paid to us in the three months immediately preceding the event giving rise to the claim.

10. Termination

Either party may terminate your access to Fruition at any time. You may cancel your account by contacting us; cancellation takes effect at the end of your current billing period. We may suspend or terminate your account immediately for violations of these terms, non-payment, or conduct harmful to the platform or other users.

Upon written request, we will delete your farm data within 30 days of termination. Certain records may be retained as required by law.

11. Changes to These Terms

We may update these Terms of Service at any time. We will revise the "last updated" date at the top of this page and make reasonable efforts to notify active users of material changes. Continued use of Fruition after changes are posted constitutes acceptance of the revised terms.
